Mediated settlement agreement in Moscow

A successful process may result in a mediated settlement agreement: a document setting out the agreements, deadlines and arrangements for performance. With the parties’ agreement, it may be notarized.

When the service is useful

  • structure of the agreed arrangements
  • deadlines and the parties’ actions
  • terms for payments or transfer of property
  • further legal formalities
  • preparation for notarization of the agreement

How the process works

First, a preliminary review of the mediated settlement agreement is carried out: who the parties are, what documents exist, the history of the conflict, acceptable options and the risks preventing agreement.

After that, the mediator helps to form a neutral invitation to the second party, agree on the format of the meeting and conduct negotiations with respect for confidentiality and equality of participants.

If the parties want greater legal certainty, the final mediated settlement agreement may be prepared with subsequent notarization in mind. This is particularly relevant for property, family, contractual and monetary obligations, where deadlines, performance arrangements and liability for a breach matter.

Mediation is not based on pressure. The goal is to find a solution that the parties are really willing to implement.
